These Terms and Conditions, including the incorporated Privacy Policy (“Terms”), govern all access to and use of the website located at https://substance-check.com (“Site”), owned and operated by SubstanceCheck (“we,” “us,” “our”). By accessing, browsing, or using this Site, or by purchasing our products (“Products”), you (“user” or “you”) acknowledge and agree to be bound by these Terms. If you do not agree, discontinue use immediately.
Our Products are not marketed, registered, or classified as medical devices or in vitro diagnostic (“IVD”) devices under applicable Thai FDA regulations. They are harm-reduction prevention tools intended for informational and educational use only, and not for diagnosis, treatment, or medical decision-making. No IVD or medical-device marks, labels, or certifications appear on primary or secondary packaging or instructions for use. We make no warranties, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. Use is at your sole risk, and you are solely responsible for any decisions or outcomes arising from reliance on any test result.
We do not make medical claims and do not represent that Products are suitable for clinical or diagnostic purposes. Without limitation, no claims—express or implied—of diagnostic performance, sensitivity, specificity, accuracy, clinical utility, or suitability for diagnosis/treatment are made. References to test outcomes are limited to preliminary indicators only.
We operate in accordance with Thai law, including consumer-protection and advertising standards. Where a product or activity is regulated, we will comply with applicable requirements; where no Thai FDA medical/IVD authorization applies (as above), none is represented or implied.
These Terms are governed by the laws of Thailand. Courts located in Bangkok, Thailand shall have exclusive jurisdiction.
You must be at least 20 years of age to use the Site or purchase Products. By using the Site, you represent and warrant that you meet this requirement.
Use of the Site and purchase of Products is limited to individuals located in Thailand.
We do not encourage or promote the consumption of drugs. Products are offered as a harm-reduction initiative to reduce risks and help users make informed decisions.
Testing results are preliminary indicators and may be affected by user error, cross-reactivity, contaminants, and other factors. A positive or negative result does not guarantee that any substance is safe. Products are not diagnostic and do not establish substance identity, purity, safety, or dose suitability; never rely on test results as a basis for consumption.
We offer drug identification/purity test kits, strips, and related products intended for personal, at-home use as preliminary indicators only. They are not definitive diagnostic tools and are not substitutes for professional medical evaluation, diagnosis, or treatment.
Interpretation of test results and subsequent actions are solely your responsibility. Consult a medical professional for advice regarding substance use or health-related matters.
Information on the Site is for general informational purposes only and does not constitute professional medical, legal, or safety advice.
All orders are subject to acceptance and availability. We may refuse, cancel, or limit quantities at our discretion.
Cash on Delivery (COD) — primary method
COD is available nationwide via our designated carrier at the time of delivery. You agree to have payment ready at delivery. Failed/Refused Delivery. If you refuse or are unable to pay on delivery or repeatedly miss attempts, we may cancel the order, charge reasonable redelivery/handling fees, and restrict future orders (including blacklisting).
COD Administrative Holding/Inspection. Without prejudice to any non-waivable requirements applicable to the COD operator, you acknowledge that, following delivery and payment, the operator may retain buyer funds for a limited administrative period to facilitate inspection and submission—only in prescribed cases and through the operator’s process—of refund requests relating to goods alleged to be not-as-described, defective, or counterfeit. For the avoidance of doubt, this administrative mechanism:
Cryptocurrency (optional)
For eligible orders, we may display support for BTC, ETH, SOL, USDT, and USDC at checkout. Payments are final and irreversible. Prices are shown in THB; the crypto payable is computed at checkout and is determined at the time the transaction is confirmed on the relevant network, using the applicable reference exchange rate for that day. Network fees are your responsibility. Volatility risk remains with the payer until on-chain confirmation is complete. We do not provide any exchange, brokerage, custody, remittance, or money-services; you are solely responsible for using a compliant wallet/service. Under-payments may delay or cancel the order; over-payments may not be refundable due to blockchain irreversibility and operational costs.
Except as may be processed strictly through the COD operator’s limited administrative mechanism described in Section 5.2 (and only for the prescribed cases), all sales are final. We do not offer refunds, returns, exchanges, or chargebacks for any reason, including change of mind. Chargebacks are inapplicable to COD and not possible with crypto.
We may cancel or refuse any order, or restrict future orders (including blacklisting), where we suspect fraud, misuse, policy violations, or non-payment risk. For COD orders, if you refuse or are unable to pay at delivery, we may cancel the order and charge reasonable redelivery/handling fees. Nothing in this Section limits any mandatory process the COD operator may apply under Section 5.2.
We ship solely within Thailand via Kerry Express to the address you provide at checkout. No international shipping is available.
Any shipping or delivery times communicated are estimates only. We are not liable for delays caused by the carrier or events beyond our control.
You are responsible for accurate, complete shipping details and being available for delivery/collection. If Kerry Express cannot complete delivery due to inaccurate details, refusal to accept COD, or repeated missed deliveries, we may cancel the order, charge reasonable redelivery/handling fees, and restrict future orders (including blacklisting).
Title and risk of loss transfer to you upon delivery by Kerry Express to your stated address.
Shipments are carried subject to Kerry Express Terms of Carriage, including liability limits (currently a monetary cap per consignment note for direct loss/damage and exclusions for delays). By placing an order, you acknowledge and accept the carrier’s standard limits and exclusions.
If Kerry Express cannot complete delivery due to inaccurate/incomplete address details, refusal to accept COD, or repeated missed delivery attempts, we may cancel the order, charge reasonable redelivery/handling fees, and restrict future orders (including blacklisting). Any COD refund processing that may be applicable is administered by the COD operator under the limited administrative mechanism referenced in Section 5.2.
From time to time, we may offer discounts, promotional codes, or special deals, subject to availability and any stated conditions.
We reserve the right to cancel, suspend, or refuse promotions or discounts if we suspect fraud, misuse, or violation of these Terms.
You agree not to use the Site or Products for unlawful purposes or in violation of applicable laws, regulations, or third-party rights.
You shall not misrepresent your age or identity, interfere with the Site’s security, introduce harmful code, or engage in activities that disrupt the Site’s normal operation.
You are solely responsible for complying with all laws regarding possession, handling, or testing of substances. Do not use the Products where doing so would be unlawful.

All Site content, including text, graphics, images, logos, and trademarks, is our property or used under license.
You shall not copy, reproduce, distribute, modify, display, or otherwise exploit any content without our express prior written permission.
You may not use our name, logo, or images for promotional, media, commercial, or any other purpose without our prior written consent.
Our Products may not be repackaged, resold, or redistributed without our prior written consent.
Field color changes and similar indicators can be affected by cross-reactivity, contaminants, and user technique. Results are preliminary and may include false positives or false negatives; use is at your own risk.
Except as required by Thai law, the Site and Products are provided on an “as-is” and “as-available” basis. We make no warranties of any kind, express or implied, regarding the Site or Products, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
To the maximum extent permitted by law, SubstanceCheck and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues, arising out of or related to your use of the Site or Products.
Our total liability shall not exceed the amount paid for the relevant Product.
You agree to defend, indemnify, and hold harmless SubstanceCheck, its officers, employees, and agents from and against any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to (a) your use or misuse of the Site or Products; (b) your violation of these Terms; or (c) your violation of any law or third-party rights.
If any provision of these Terms is held to be invalid, illegal, or unenforceable, such provision shall be enforced to the maximum extent permissible and the remaining provisions shall remain in full force and effect.
These Terms shall be governed by the laws of Thailand, without regard to conflict of laws principles.
Any disputes shall be submitted to the exclusive jurisdiction of the courts located in Bangkok, Thailand.
We reserve the right to update or modify these Terms at any time.
Changes will be posted on the Site with a new “Last Updated” date. Your continued use of the Site after such updates constitutes acceptance.
